Terms and Conditions

1. Introduction

eeZee PAY is a payment transaction and digital market place for consumers and merchants to trade goods and services. It is owned and operated by The Payment House Group, hereinafter referred to as (TPH), through its operating companies in the UK, Norway, Sweden and Latvia.

2. General

eeZee PAY is a digital payment and product sales service (eeZee PAY) offered by The Payment House Group (including its subsidiaries and affiliates) (TPH), that electronically stores your selected account data, payment information in one convenient place and transmits that information at your request to participating merchants that display eeZee PAY checkout button on their website, mobile site, smart device application, for in app product sales, or in-person point of sales terminal.

These Terms of Use (TOU) and eeZee PAY Privacy Policy (Privacy Policy) and, together with these TOU, these (Terms) are a legal agreement between you and TPH. BY REGISTERING AS AN EEZEE PAY MEMBER, WHICH INCLUDES CLICKING TO ACCEPT THESE TERMS, YOU AGREE TO ALL OF THE TERMS AND CONDITIONS IN THESE TERMS, AND ALL OTHER RULES, POLICIES AND PROCEDURES RELATING TO EEZEE PAY AND THAT TPH MAY PROVIDE YOU FROM TIME TO TIME (AS DESCRIBED IN THESE TERMS).  YOU ALSO AGREE TO COMPLY WITH THE TERMS, CONDITIONS AND PROVISIONS OF THE ISSUER(S) OF YOUR CARD(S) (AS DEFINED BELOW).

(You) (and all of its derivations) means you individually and any person acting as your agent, under your authority, or with your permission, and if you are accepting these Terms on behalf of a company or other legal entity, then that legal entity. You represent and warrant that you are: (i) at least 18 years of age (or the minimum age in your jurisdiction for entering into a binding contract) or, (ii) capable of entering into a legally binding agreement, and (iii) a legal resident of one of the countries where eeZee PAY is accepted. If you are entering into these Terms on behalf of a company or other legal entity, you further represent and warrant that: (x) you have the authority to bind the legal entity, (y) such legal entity is authorized to conduct business in the jurisdiction(s) in which you operate, and (z) all employees, officers, agents, and other representatives of the legal entity who use your eeZee PAY membership are duly authorized to access it and to engage in transactions using your eeZee PAY member account. IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST NOT REGISTER FOR AN EEZEE PAY ACCOUNT OR USE EEZEE PAY.

If you use eeZee PAY on behalf of a company or other entity these Terms provide that all disputes between you and TPH will be resolved by BINDING ARBITRATION. YOU AGREE TO GIVE UP YOUR RIGHT TO GO TO COURT to assert or defend your rights under this contract, except for matters that may be taken to small claims court. Your rights will be determined by a NEUTRAL ARBITRATOR and NOT a judge or jury, and your claims cannot be brought as a class action.

Please review Section 26 (Dispute Resolution and Arbitration) for the details regarding your agreement to arbitrate any disputes with TPH. This clause shall not apply if you are using eeZee PAY as a consumer.

3. Setting Up Your eeZee PAY account

You may register for an eeZee PAY account by providing TPH with the information set forth on eeZee PAY registration pages, including (and where applicable) a valid email address and mobile phone number, security question/answer, sign-in message, and password. You may then store payment information (card number and expiration date), billing information and other information for your credit, debit, and reloadable prepaid cards (Cards), rewards cards (Rewards Numbers) supported by eeZee PAY (as indicated on the registration pages), and your preferred shipping information. All of the information for your Cards, Rewards Numbers, and shipping information are collectively referred to in these Terms as your (Payment Information.”

4. Protecting and updating your account

  • Password

You are responsible for keeping your eeZee PAY password secure and for all activities that occur through or by usage of eeZee PAY, including the activities of others (whether or not the activities are authorized). You must immediately notify TPH of unauthorized access to or use of your eeZee PAY account. TPH reserves the right to require you to change any of your passwords if TPH believes they are no longer secure. Neither TPH nor its agents will be liable for any loss or damages of any kind that may arise as a result of the unauthorized access to or use of your eeZee PAY membership account or any Payment Information (with or without your knowledge), except to the extent the foregoing limitation is prohibited under applicable law.

  • Maintaining up-to-date information

You are solely responsible for maintaining up-to-date and accurate information pertaining to your eeZee PAY account, including all Payment Information. TPH has no responsibility for the authenticity, validity, accuracy, or completeness of the Payment Information TPH transmits on your behalf.

5. Using your eeZee pay membership account

  • General

When you click the (Finish Shopping) (or similar) button in eeZee PAY app or on the site of another eeZee PAY-connected account, TPH will transmit your selected Payment Information to eeZee PAY Merchant.  After eeZee PAY Merchant receives your Payment Information, it will submit the transaction for processing.

  • Connect with eeZee Pay

eeZee PAY may provide you the opportunity to connect your eeZee PAY account to certain merchants you select to allow for a faster checkout via two methods. You will be provided one option during check-out on an eeZee PAY Merchant website or application.  After you have reviewed and confirmed your order details during checkout, a screen will appear providing you the option to connect your eeZee PAY account with eeZee PAY Merchant. The second option to connect is by clicking on the (Connect with eeZee PAY) button on an eeZee PAY Merchant website or application. You will then have the opportunity to approve connecting your chosen eeZee PAY Account to a specific eeZee PAY Merchant. Once your account is connected to an eeZee PAY Merchant, by clicking the (Buy with eeZee PAY) button on that merchant’s website or application, you will see your relevant Payment Information and only need to log-into your eeZee PAY Account to complete the transaction.

  • Express checkout

Certain eeZee PAY Merchants may provide you the option of an (Express Checkout) which allows you to check out without logging into your eeZee PAY if you are logged into eeZee PAY Merchant’s website. If an eeZee PAY Merchant provides Express Checkout, you will be notified during the process of connecting your account and will have the opportunity to allow or decline connecting you eeZee PAY account for Express Checkout. If you enable Express Checkout at an eeZee PAY Merchant and are logged into that Merchant’s website or application, you can complete your transaction by clicking the (Buy with eeZee PAY) button during checkout. You may disconnect your account from any eeZee PAY Merchant at any time from the Connections page in the account settings of your eeZee PAY Account

  • Transaction with eeZee pay merchant

Each purchase or payment that you make using your eeZee PAY account is a contractual relationship directly between you and eeZee PAY Merchant, and eeZee PAY Merchant’s terms and conditions will govern all aspects of that business transaction. TPH is only handling payment processing and has no liability to you or eeZee PAY Merchant with respect to the business transaction.

6. Use of your payment information

  • Your responsibilities

Each purchase or payment that you make using your eeZee PAY account is a contractual relationship directly between you and eeZee PAY Merchant, and eeZee PAY Merchant’s terms and conditions will govern all aspects of that business transaction. TPH is only handling payment processing and has no liability to you or eeZee PAY Merchant with respect to the business transaction.

  • TPH is not a card issuer

TPH is not a bank or a money services business as defined by the PCI Security Standards Council, the European Central Bank, or the United States Department of Treasury and does not offer those services. TPH does not issue Cards or Rewards Numbers of any kind.  Any and all questions or issues regarding any of your Cards or Rewards Numbers should be directed to the bank or financial institution that issued your Card, or the party offering the Rewards Numbers, as applicable, and not to TPH. TPH MAKES NO REPRESENTATIONS THAT YOUR CARDS OR REWARDS NUMBERS ARE VALID OR IN GOOD STANDING OR THAT THE PARTIES WHO ISSUED YOUR CARDS OR REWARDS NUMBERS WILL APPROVE OR HONOR YOUR REQUESTED TRANSACTIONS.

  • Resolutions of transaction issues

If you have any concerns with respect to any transaction made using eeZee PAY, you must contact the TPH Merchant with which you entered into that transaction. You may also have certain rights and protections under your agreement with the bank or financial institution that issued your Card or under applicable law with respect to the charges for transactions made to your registered Cards. Consult your agreement with your Card issuer for details and applicable laws.

7. Grant of licence

  • eeZee Pay licence

So long as you comply with these Terms, TPH grants you a limited, nonexclusive, as-is, revocable, non-transferable license, without right of sublicense, to use eeZee PAY solely for the purpose of storing and transmitting your Payment Information to eeZee PAY Merchants

  • Mobile app licence

So long as you comply with these Terms, TPH grants you a limited, as-is, non-exclusive, non-transferable, non-sublicenseable, revocable license to the Mobile App downloaded directly from eeZee PAY site or from a legitimate marketplace (such as the Apple Store or Google Play), solely in object code format, for your personal use for lawful purposes, on a single compatible mobile device you own or control, and to access and use your eeZee PAY account in accordance with these Terms. You may not reproduce, distribute, publicly display, or publicly perform the Mobile App. You may not use the Mobile App for any purpose other than a purpose for which the Mobile App is expressly designed. The term Mobile App, as used in these Terms, includes any update or modification to the Mobile App made available to you by TPH (unless provided with separate terms). If you are prohibited under applicable law from using the Mobile App, you may not use it. In addition, You shall especially further agree to the following acceptable use terms.

Prohibited Conduct . You shall not use eeZee PAY app for any other purpose that what it is designed for and shall not:

decompile, reverse engineer, or otherwise access or attempt to access the source code for the Mobile App or otherwise relating to eeZee PAY, or make or attempt to make any modification to the Mobile App or eeZee PAY (except to the extent the foregoing prohibition is not permitted under applicable law);

gain access to or use TPH’s services or systems, or eeZee PAY other than as permitted under these Terms, or damage, disrupt, or impede the operation of TPH’s services or systems;

use eeZee PAY in connection with any fraudulent or illegal conduct, transaction, or business, as determined by TPH in its sole discretion;

register for an eeZee PAY account by automated means or under false or fraudulent pretences;

interfere with, circumvent, or modify any security mechanism used by or on behalf of TPH, including in the Mobile App;

use or launch any automated system, including (robots,) (spiders,) or (offline readers,) to access eeZee PAY;

act as a payment intermediary, aggregator, or service bureau yourself or on behalf of any third party, including handling, processing, or transmitting funds for any third party;

(rent, lease, loan, trade, sell, re-sell, or otherwise charge any party for access to eeZee PAY;

transmit any viruses, worms, defects, Trojan horses, or any programming of a destructive nature; or

attempt to do any of the foregoing acts, or assist or permit any person in engaging in any of the foregoing acts.

Compliance with Law.

You must comply with all applicable international, federal, state, and local laws, rules, regulations, directives, and governmental requirements relating to your use of eeZee PAY. TPH may, in its sole discretion, accept or reject your request to register an eeZee PAY membership account and may disable or otherwise suspend access to your eeZee PAY account or to any Payment Information within your eeZee PAY account at any time for any reason or no reason whatsoever, including if TPH suspects fraud or illegal, unauthorized or improper conduct.

8. Text message and carrier fees

  • Text messages

When you register for an eeZee PAY account, you agree to receive various notices in the form of text messages sent to your mobile phone.  By registration, you expressly agree and consent to receive those text messages.  Your standard messaging, airtime, and data rates will apply. The number of messages you will receive each month will vary according to the number of transactions you make and the preferences you select during the registration process. You may change your preferences at any time by logging in to your eeZee PAY account and editing your preferences in your account settings.

  • Message may be delayed

If your mobile phone is off, out of range, or subject to a variety of other conditions, you may not receive all messages or messages may be delayed.  Cellular and other wireless transmission services and networks are inherently insecure and subject to service disruptions, weak or dropped signals, and other failures over which TPH has no control.  TPH ASSUMES NO RESPONSIBILITY OR LIABILITY FOR ANY DELAYS OR FAILURE TO RECEIVE TEXT MESSAGES OR OTHER MOBILE-BASED INFORMATION OR ANY SECURITY BREACHES RELATED TO ANY OF THE FOREGOING.

  • Carrier fees

You are responsible for any fees and penalties charged by your telecommunications provider or any other third party in connection with your use of eeZee PAY on your mobile device

9. Modifications to eeZee pay

  • Fees and charges

While TPH currently makes eeZee PAY available free of charge, TPH may in the future charge for eeZee PAY (or any additional features or functionality) at any time, in its sole discretion, and will notify you in advance of such future charges to the extent required under applicable laws. On receiving notice of such charges, you will be given a reasonable time in which to cancel your use of eeZee PAY and the Mobile App without charge. TPH may also discontinue, modify, or change eeZee PAY, or TPH’s services and systems at any time and will notify you in advance of such discontinuance, modification, or change to the extent required under applicable laws. These changes may require you to update your Payment Information or other information related to your eeZee PAY account in order to continue using eeZee PAY. TPH will not have any liability or obligation to you with regard to any modifications or changes it makes to eeZee PAY, or TPH’s services or systems.

  • Modifications to these terms

TPH may, at any time and from time-to-time, change the terms of these Terms or provide other disclosures or notices regarding eeZee PAY by posting them on eeZee PAY website or Mobile App, delivering them to you through eeZee PAY or emailing them to you at the email address associated with your eeZee PAY account. You will be deemed to have received those disclosures and notices within twenty-four (24) hours after TPH posts or delivers them or emails them to you.  If you do not accept those revisions to these Terms or other disclosures or notices regarding eeZee PAY, your only recourse is to stop using eeZee PAY and the Mobile App and terminate your account. Your continued use of eeZee PAY and/or the Mobile App after such effective date will constitute your acceptance of the revisions that apply to that service.

10. Feedback

From time to time, TPH may ask you for (or you may independently provide TPH with) your feedback, suggestions, comments, or ideas (collectively (Feedback) on eeZee PAY or other TPH products or services but you are not required to provide us with any Feedback.  You agree that TPH may use and exploit all Feedback you provide for any purpose without obligation of any kind and without any obligation of confidentiality, attribution, accounting, compensation, or other duty to account to you

11. Ownership and rights

As between you and TPH, TPH owns and retains all right, title, and interest, including all intellectual property rights, in and to (a) eeZee PAY, including eeZee PAY accounts; (b) the Mobile App; and (c) TPH’s systems and services (collectively, (TPH Property). TPH, its licensors, or third party partners own and retain all right, title, and interest in all names, trade names, trademarks, service marks, slogans, logos, domain names, or other indicia of TPH or its licensors or third party partners used in connection with eeZee PAY, including (eeZee PAY,) (eeZee PAY Mobile Apps,) (eeZee PAY-connected Wallets,) (eeZee PAY Online,) eeZee PAY Checkout Button logo, and (eeZee PAY Checkout Services) (Trademarks).  You have no right to use any Trademark in any manner without the advance written permission of the owner of that Trademark. TPH reserves all rights in the TPH Property and Trademarks not expressly granted to you in these Terms

12. Products and services offered by eeZee pay merchants

Each purchase through eeZee PAY of a product or service offered by an eeZee PAY Merchant is subject to eeZee PAY Merchant’s specific terms and conditions, which are set forth in the full description of the product or service and is a contractual relationship directly between you and eeZee PAY Merchant. The inclusion of an eeZee PAY Merchant’s products or services in any product, service, or technology that allows or requires you to checkout with your eeZee PAY account does not constitute any approval, endorsement, or warranty by TPH of the products or services or of eeZee PAY Merchant offering them

13. Third party sites

eeZee PAY may contain third party content and links to third party sites or popups served by or on behalf of third parties that are independent of eeZee PAY and not owned or controlled by TPH (Third Party Sites). Links to Third Party Sites are included, and popups served by or on behalf of third parties are facilitated, solely for the convenience of users and do not constitute any approval, endorsement, or warranty by TPH. Moreover, TPH is not responsible for the content, security, operation, or use of any Third Party Sites or the products or services that may be offered or obtained through them or for the accuracy, completeness, or reliability of any information obtained from a Third Party Site. When you click on a link to or in a popup of a Third Party Site, you will leave the services controlled by TPH. Any personal information you submit after you leave eeZee PAY will not be collected or controlled by TPH. It will be subject to the privacy notice or terms of use applicable to the Third Party Site. It is your responsibility to review those policies before submitting your information to the Third Party Site and you provide your information at your own risk. YOU EXPRESSLY RELIEVE TPH FROM ANY AND ALL LOSS, DAMAGES OR OTHER LIABILITIES YOU INCUR AS A RESULT OF YOUR ACCESS TO OR USE OF ANY THIRD PARTY SITE

14. Privacy

TPH recognizes the importance of respecting your privacy.  The Privacy Policy provides a description of how TPH collects, uses, shares, and protects your personal information related to eeZee PAY, as well as the choices and access rights you have in regard to your personal information.

15. Your representation

You represent and covenant that (a) the information you provide to TPH in connection with your registration for an eeZee PAY account is true and correct and you will keep it accurate and up-to-date at all times; and (b) you will comply with these Terms and all applicable local, state, federal, and international laws, rules, and regulations in connection with your use of eeZee PAY.

16. Indemnification

You agree to indemnify and hold harmless TPH and its business partners, and its and their officers, directors, employees, representatives and affiliates (the (Indemnified Parties) from and against any and all claims, liabilities, damages (actual and consequential), losses, fines, and expenses (including legal and other professional fees and costs of investigation) arising from or in any way related to (a) your use of eeZee PAY; (b) your (or anyone using your eeZee PAY account) breach of these Terms or applicable law; (c) your negligence or willful misconduct; (d) any dispute between you and a third party, including any eeZee PAY Merchant or financial institutions; or (e) your violation of any third party’s rights, including any intellectual property rights.

17. Disclaimer of warranties

  • General disclaimer

EEZEE PAY IS PROVIDED (AS IS,) (AS AVAILABLE,) AND WITH ALL FAULTS. TO THE EXTENT PERMITTED BY APPLICABLE LAW, THE INDEMNIFIED PARTIES DISCLAIM ALL WARRANTIES, CONDITIONS AND TERMS EXPRESS OR IMPLIED, INCLUDING ANY WARRANTIES OF MERCHANTABILITY, QUALITY OF INFORMATION, QUIET ENJOYMENT, NON-INFRINGEMENT, TITLE, OR FITNESS FOR A PARTICULAR PURPOSE. TPH DOES NOT WARRANT THAT THE INFORMATION CONTAINED IN EEZEE PAY (INCLUDING ANY INFORMATION RELATED TO A EEZEE PAY MERCHANT’S PRODUCTS OR SERVICES) OR ON ANY THIRD PARTY SITE WILL BE ACCURATE OR COMPLETE, OR THAT EEZEE PAY OR ANY THIRD PARTY SITE WILL BE ERROR FREE, UNINTERRUPTED, FREE FROM SPYWARE, MALWARE, ADWARE, VIRUSES, WORMS, OR OTHER MALICIOUS CODE, OR WILL FUNCTION TO MEET YOUR REQUIREMENTS. TPH DOES NOT WARRANT THAT EEZEE PAY WILL WORK ON YOUR HARDWARE, WITH YOUR OPERATING SYSTEMS, OR WITH ANY OTHER SOFTWARE INSTALLED ON YOUR COMPUTERS OR MOBILE DEVICES. INFORMATION OBTAINED BY YOU FROM TPH WILL NOT CREATE ANY WARRANTIES. IT IS YOUR SOLE RESPONSIBILITY TO DETERMINE WHETHER EEZEE PAY IS SUITABLE AND ADEQUATE FOR YOUR NEEDS

  • Disclaimer regarding transaction

YOU SPECIFICALLY ACKNOWLEDGE THAT TPH DOES NOT HAVE ANY CONTROL OVER YOUR TRANSACTIONS USING PAYMENT INFORMATION TRANSMITTED BY EEZEE PAY ON YOUR BEHALF, AND TPH CANNOT ENSURE THAT ALL TRANSACTIONS WILL BE COMPLETED OR THAT THE PERSON WHO HAS ISSUED YOUR CARD OR REWARDS NUMBER, AS APPLICABLE, WILL AUTHORIZE THE TRANSACTIONS THAT YOU INITIATE.

18. Limitation of liability

  • Limitation

TO THE EXTENT PERMITTED BY APPLICABLE LAW, IF YOU USE EEZEE PAY ON BEHALF OF A COMPANY OR OTHER LEGAL ENTITY REGARDLESS OF WHETHER ANY REMEDY IN THESE TERMS FAILS OF ITS ESSENTIAL PURPOSE OR OTHERWISE, THE INDEMNIFIED PARTIES ARE NOT AND WILL NOT BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, SPECIAL, PUNITIVE, EXEMPLARY, CONSEQUENTIAL, OR ANY OTHER DAMAGES WHATSOEVER, INCLUDING ANY PROPERTY DAMAGE, LOSS OF USE, LOSS OF BUSINESS, ECONOMIC LOSS, LOSS OF DATA, OR LOSS OF PROFITS, WITHOUT REGARD TO THE FORM OF ACTION (INCLUDING CONTRACT, NEGLIGENCE, OR OTHER TORTIOUS ACTIONS) ARISING OUT OF OR IN CONNECTION WITH (A) THESE TERMS; (B) EEZEE PAY, INCLUDING YOUR USE OF EEZEE PAY IN COMBINATION WITH ANY THIRD PARTY APPLICATION; (C) ANY INTERRUPTION IN SERVICE RELATED TO EEZEE PAY; (D) ANY CARD, REWARDS NUMBER, OR THIRD PARTY SITE; (E) ANY PRODUCT OR SERVICE OBTAINED THROUGH A TRANSACTION EXECUTED USING PAYMENT INFORMATION TRANSMITTED BY EEZEE PAY; (F) THE ACTIONS OR INACTIONS OF ANY EEZEE PAY MERCHANT; (G) YOUR USE OF YOUR MOBILE DEVICE, INCLUDING ANY LACK OF ATTENTION TO YOUR SURROUNDINGS RESULTING FROM SUCH USE; OR (H) THE UNAUTHORIZED ACCESS BY ANY PARTY TO TPH’S SERVICES AND SYSTEMS, INCLUDING PERSONAL DATA,  EVEN IF ANY OF THE INDEMNIFIED PARTIES HAS BEEN ADVISED OF THE POSSIBILITY OF THOSE DAMAGES. YOU WAIVE ANY AND ALL CLAIMS, NOW KNOWN OR LATER DISCOVERED, THAT YOU MAY HAVE AGAINST THE INDEMNIFIED PARTIES ARISING OUT OF YOUR USE OF EEZEE PAY, YOUR MOBILE DEVICE OR THESE TERMS. WITHOUT LIMITING THE FOREGOING, TPH IS NOT RESPONSIBLE FOR ANY ERRORS IN ANY REWARDS NUMBER DETAILS, DESCRIPTIONS OF PRODUCTS OR SERVICES OFFERED BY EEZEE PAY MERCHANTS OR ANY MOBILE CARRIER FEES OR PENALTIES OR CARD ACCOUNT FEES OR PENALTIES THAT YOU INCUR AS A RESULT OF YOUR USE OF EEZEE PAY, INCLUDING ANY FEES AND PENALTIES THAT MAY RESULT FROM TRANSACTION REVERSALS.

WE DO NOT EXCLUDE OR LIMIT IN ANY WAY OUR LIABILITY TO YOU WHERE IT WOULD BE UNLAWFUL TO DO SO. THIS INCLUDES LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY OUR NEGLIGENCE OF OUR EMPLOYEES OR AGENTS; FOR FRAUD OR FRAUDULENT MISREPRESENTATION; AND WHERE YOU ARE CONTRACTING AS A CONSUMER, FOR BREACH OF YOUR LEGAL RIGHTS IN RELATION TO EEZEE PAY

  • Cap on liability

NOTWITHSTANDING THE FOREGOING, THE INDEMNIFIED PARTIES’ TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE WILL NOT, UNDER ANY CIRCUMSTANCES, EXCEED ONE HUNDRED EUROS (EUR 100,00).

  • Essential elements

THE FOREGOING LIMITATIONS AND EXCLUSIONS APPLY EXCEPT TO THE EXTENT EXPRESSLY PRECLUDED BY APPLICABLE LAW. IN THOSE JURISDICTIONS, ALL OR A PORTION OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU AND THE SCOPE AND DURATION OF THE INDEMNIFIED PARTIES’ WARRANTIES AND THE EXTENT OF THEIR LIABILITY WILL BE THE MINIMUM PERMITTED UNDER APPLICABLE LAW.  NOTHING IN THESE TERMS SHALL AFFECT YOUR STATUTORY RIGHTS.

19. Termination

  • Term and Termination

These Terms will be effective until terminated as provided in this Section 19. Upon notice, TPH may suspend or terminate your use of eeZee PAY, access to your eeZee PAY account, or your access or use of any Payment Information in your eeZee PAY mobile application at any time, with or without cause, including in the event TPH believes (i) your contact information is not up-to-date or you do not respond to communications directed to you; (ii) the information you have provided to obtain your eeZee PAY account is false, inaccurate, not current, or incomplete; (iii) you are engaged in illegal activity; (iv) you have breached any of these Terms; or (v) your eeZee PAY account has been inactive for more than thirteen (13) months.  You may terminate these Terms with respect to eeZee PAY or for any reason or no reason at all, at your convenience, by ceasing all use of eeZee PAY and the Mobile App.

  • Effect of termination

Upon termination of these Terms for any reason, the rights and licenses granted to you with respect to eeZee PAY and the Mobile App will immediately terminate and you will have to immediately cease all use of eeZee PAY and the Mobile App. The terms, conditions, and warranties contained in these Terms that by their nature and context are intended to survive the termination of these Terms will survive, including Section 5 (Use of Your Payment Information), Section 6 (Resolution of Transaction Issues), Section 10 (Feedback), Section 11 (Ownership and Rights), Section 13 (Third Party Sites), Section 14 (Privacy), Section 15 (Your Representations), Section 16 (Indemnification), Section 17 (Disclaimer of Warranties), Section 18 (Limitation of Liability), Section 19 (Termination), Section 25 (Governing Law), Section 26 (Dispute Resolution and Arbitration), and Section 30 (Assignment). TPH will have no liability to you for any damages, loss of profits or other claims arising from the termination or suspension of your access to eeZee PAY

21. Notifications

Unless provided otherwise by TPH in connection with eeZee PAY, all notices required from you under these Terms must be sent to the addresses specified by TPH from time-to-time, in its sole discretion. You consent to receiving certain electronic communications from us as further described in our Privacy Policy. Please read our Privacy Policy to learn more about our electronic communications practices. You agree that any notices, agreements, disclosures, or other communications that we send to you electronically will satisfy any legal communication requirements, including that those communications be in writing.

22. Entire Agreements

These Terms constitute the entire agreement between you and TPH with regard to their subject matter.

23. Relationship of parties

These Terms do not create and must not be construed as creating a joint venture, co-ownership, partnership, or agency relationship between you and TPH.

24. TPH Third Party Beneficiaries

You acknowledge and agree that each affiliate and subsidiary of TPH is a third party beneficiary to these Terms and that TPH’s affiliates and subsidiaries are entitled to directly enforce, and rely upon, any provision of these Terms which confers a benefit on (or provides rights in favor of) them. No other person or company is a third party beneficiary to these Terms.

25. Governing Law

If you are using eeZee PAY as a consumer, these Terms are governed by British, Norwegian and Swedish laws and you can bring legal proceedings in respect of eeZee PAY in Great Britain, Norway and Sweden.

If you are using eeZee PAY on behalf of a company or other legal entity these Terms are governed by Norwegian laws. If a lawsuit or court proceeding is permitted under these Terms, then you and TPH agree to submit to the personal and exclusive jurisdiction of the state courts and federal courts located within Oslo, Norway for the purpose of litigating any dispute. You agree that regardless of any statute or law to the contrary, any claim or cause of action that you may have arising out of or related to these Terms must be filed within one (1) year after the claim or cause of action arose.

26. Dispute resolution and arbitration

his clause applies only if you are using eeZee PAY on behalf of a company or other legal entity

  • General

In the interest of resolving disputes between you and TPH in the most expedient and cost effective manner, you and TPH agree that every dispute arising in connection with these Terms will be resolved by binding arbitration. Arbitration is less formal than a lawsuit in court. Arbitration uses a neutral arbitrator instead of a judge or jury, may allow for more limited discovery than in court, and can be subject to very limited review by courts. Arbitrators can award the same damages and relief that a court can award. This agreement to arbitrate disputes includes all claims arising out of or relating to any aspect of these Terms, whether based in contract, tort, statute, fraud, misrepresentation, or any other legal theory, and regardless of whether a claim arises during or after the termination of these Terms. YOU UNDERSTAND AND AGREE THAT, BY ENTERING INTO THESE TERMS, YOU AND TPH ARE EACH WAIVING THE RIGHT TO A TRIAL BY JURY OR TO PARTICIPATE IN A CLASS ACTION.

  • Exceptions

Despite the provisions of Section 26(a), nothing in these Terms will be deemed to waive, preclude, or otherwise limit the right of either party to: (i) bring an individual action in small claims court; (ii) pursue an enforcement action through the applicable federal, state, or local agency if that action is available; (iii) seek injunctive relief in a court of law; or (iv) to file suit in a court of law to address an intellectual property infringement claim.

  • Arbitration

Any arbitration between you and TPH will be settled under the The Arbitration and Dispute Resolution Institute of the Oslo Chamber of Commerce, . Henrik Ibsens gate 100, 0255 Oslo, Norway, http://www.chamber.no.

  • Notice; Process

A party who intends to seek arbitration must first send a written notice of the dispute to the other party by certified Mail or by Federal Express (signature required) or, only if such other party has not provided a current physical address, then by electronic mail (Notice). TPH’s address for Notice is defined in Section 1. The Notice must: (i) describe the nature and basis of the claim or dispute; and (ii) set forth the specific relief sought (Demand). The parties will make good faith efforts to resolve the claim directly, but if the parties do not reach an agreement to do so within thirty (30) days after the Notice is received, you or TPH may commence an arbitration proceeding. During the arbitration, the amount of any settlement offer made by you or TPH must not be disclosed to the arbitrator until after the arbitrator makes a final decision and award, if any. If the dispute is finally resolved through arbitration in your favour, TPH will pay you the highest of the following: (A) the amount awarded by the arbitrator, if any; (B) the last written settlement amount offered by TPH in settlement of the dispute prior to the arbitrator’s award; or (C) one thousand Euros (EUR 1,000).

  • Fees

If you commence arbitration in accordance with these Terms, you hereby agree to cover the arbitrators filing fees and cover all your cost during the arbitration proceedings.

  • No Class Actions

YOU AND TPH AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Further, unless both you and TPH agree otherwise, the arbitrator may not consolidate more than one person’s claims, and may not otherwise preside over any form of a representative or class proceeding.

  • Modifications to this Arbitration Provision

If TPH makes any future change to this arbitration provision, other than a change to TPH’s address for Notice, you may reject the change by sending us written notice within thirty (30) days of the change to TPH’s address for Notice, in which case your account with TPH will be immediately terminated and this arbitration provision, as in effect immediately prior to the changes you rejected will survive.

  • Enforceability

If Section 26.6 is found to be unenforceable or if the entirety of this Section 26 is found to be unenforceable, then the entirety of this Section 26 will be null and void and, in that case, the parties agree that the exclusive jurisdiction and venue described in Section 25 will govern any action arising out of or related to these Terms.

27. Waiver; invalidity

TPH’s failure or delay to exercise or enforce any right or provision of these Terms or any rights under applicable law will not constitute a waiver of any of those provisions or rights. If any provision of these Terms is found by an arbitrator or a court of competent jurisdiction to be invalid, the parties agree that the arbitrator or court will endeavour to give effect to the parties’ intentions as reflected in the provision, and the other provisions of these Terms will remain in full force and effect.

28. Interpretation

The section headings in these Terms are for convenience only and have no legal or contractual effect. For purposes of these Terms, (a) the words (include,) (includes) and (including) will be deemed to be followed by the words (without limitation;”; (b) the words (such as), (for example) (e.g.) and any derivatives of those words will mean by way of example and the items that follow these words will not be deemed an exhaustive list; (c) the word (or) is used in the inclusive sense of (and/or) and the terms (or,) (any,) and (either) are not exclusive; and (d) the singular includes the plural and the plural includes the singular. No ambiguity will be construed against any party based on a claim that the party drafted the language.

29. Assignment

You may not assign or transfer your rights or obligations under these Terms. Any purported transfer or assignment in violation of the foregoing will be invalid.

30. Force majeure

TPH will not be liable for any delay or failure to perform its obligations hereunder resulting from any cause beyond its reasonable control, including without limitation, telecommunications, power or utility failures.

The Payment House Group and its affiliates (TPH) (We) or (we) respect your privacy.  This Privacy Notice applies to all TPH mobile applications, eeZee PAY, eeZee POS, eeZee TAXI as well as our Web Services related to our eeZee PAY solution that can be accessed by your eeZee PAY membership account.

1 What This Privacy Notice Covers and Does Not Cover

This Privacy Notice describes the types of personal data we collect in connection with eeZee PAY System, the purposes for which we collect that personal data, the other parties with whom we may share it and the measures we take to protect the security of the data. It also tells you about your rights and choices with respect to your personal data, and how you can reach us to update your contact information or get answers to questions you may have about our privacy practices.

However, it is important to note that this Privacy Notice does not cover the following:

Merchants:  This Privacy Notice does not cover the collection and use of your personal data by merchants using eeZee PAY payment services inside their own applications.  Please make sure to review your merchant’s privacy disclosures to understand how they are collecting and using your personal data.

Financial Institutions:  This Privacy Notice also does not cover the collection and use of your personal data by your financial institution.  Please make sure to review your financial institution(s) privacy disclosures to understand how they are collecting and using your personal data.

3 Personal Data We Collect and Present

We collect Personal Data about you through our TPH Mobile Applications and in connection with your use of eeZee PAY.  By personal data we mean (any information relating to an identified or identifiable natural person.”

Personal Data collected through eeZee PAY Mobile Application

Personal Data that is automatically collected through both eeZee PAY Websites and eeZee PAY mobile application.

3.1 Personal Data Collected through eeZee PAY Websites

3.1.1 Personal Data Provided By Your Financial Institutions

In some instances, we may receive data about you from your financial institution in order to help ensure you provide the correct eeZee PAY account information.  For example, your financial institution may provide us with your email address or phone number.  This will be used to help you create the appropriate eeZee PAY setup with a participating financial institution.

3.1.2 Personal Data Provided By You

When you register to create any eeZee PAY account or attempt to sign in to any eeZee PAY account through eeZee PAY portal, we may ask you for certain personal data, including email address, phone number and payment card information.  The provision of this personal data is voluntary.  However, withholding this personal data will mean that you cannot take advantage of eeZee PAY services.

We use this data for the following purposes:

When you click on the (Buy With eeZee PAY) button at a merchant or otherwise sign-up for or sign-in to eeZee PAY, you will be asked for certain personal data, such as your email or phone number.  If the information you provide matches the information provided by your financial institution (see above), you may be directed to a specific eeZee PAY relating to that financial institution.  We also use this information to help enhance the security of eeZee PAY platform and reduce fraud.

If you do not have an existing eeZee PAY account, we will ask you to provide the payment card you would like to use to complete a transaction.  We may use this information to determine if the applicable financial institution that issued your payment card has an eeZee PAY program.  If so, we will route to that wallet.  That information may also be used to create your eeZee PAY account.

3.2 Personal Data collected through eeZee PAY Mobile Application

We collect data in a number of ways when you use eeZee PAY:  personal data provided by you; personal data provided by participating merchants; personal data provided by the issuer of your payment cards or other financial institutions; and personal data provided by you in connection with other TPH eeZee mobile applications on your device.  That data collection is described below.

3.2.1 Personal Data Provided by You

In connection with your use of eeZee PAY, we may ask you for certain personal data upon registration, or on applications forms or other forms, such as your name, home address, billing address, shipping address, telephone number, email address, national identity card number in some instances, user name, password, answers to our security questions, loyalty card information and payment card information. The provision of your personal data for the purposes listed below is voluntary.  However, in some circumstances, withholding your personal data will mean that you cannot take advantage of certain products or services.

3.2.2 Personal Data Provided by Participating Merchants in Connection with Your Use of eeZee PAY

We receive certain data from merchants about your transactions using eeZee PAY, including but not limited to, stock-keeping unit data, description of items, quantity, price and subtotal and payment cards registered with eeZee PAY, merchant name, currency, amount, date and time of order and information about whether or not the order was completed.  If you have an account on file with the merchant, they may also provide us with your shipping address.

3.2.3 Personal Data Provided by the Issuer of Your Registered Payment Card or Other Financial Institution

When you register a payment card with eeZee PAY, we will send information to the issuer of that card to validate the card, authenticate your identity and tokenize your payment credentials to make your payments more secure.  This information may include your name, payment card information, billing address, information about your mobile device and information about how you registered your payment cards in your eeZee PAY account. To facilitate the validation/authentication/tokenization process, we may receive personal data about you back from the issuer of your payment card card.  In addition, when you make payments using tokenized credentials vian eeZee PAY, we receive data about the token and the transaction back from the issuer of your payment card.

3.3 Personal Data We Collect Automatically

3.3.1 Overview

We, and our service providers, may collect certain information by using automated means, such as cookies and web beacons, when you interact with eeZee PAY, or visit eeZee PAY Websites, pages or other digital assets. The information we collect in this manner may include: IP address, mobile device IP address, mobile device unique identifier, browser type and setting data (such as screen resolution, color depth, time zone settings, browser extension and plugins, fonts, etc), operating system, referring URLs and information on actions taken or interaction with our digital assets. A (cookie) is a text file placed on a computer’s hard drive by a web server. A (web beacon,) also known as an Internet tag, pixel tag or clear GIF, is used to transmit information back to a web server.

This information is collected and used for the purposes described in this Section and in Section 4, below.  In addition, this information will be used to enhance the security of eeZee PAY Websites, eeZee PAY, the TPH network and to protect against and prevent fraud, unauthorized transactions, claims and other liabilities, and manage risk exposure and franchise quality.

3.3.2 Browser Data

In addition to the above, we, and our service providers, may automatically collect browser data from your device. Browser data consists of information about settings on the configuration of the browser you use to access eeZee PAY and eeZee PAY Websites. This may include screen resolution and color depth, time zone settings, browser extensions and plugs installed in the browser and versions thereof, fonts installed on the browser, the user agent string and other similar data. This data is used to create a unique fingerprint of the browser used to access eeZee PAY Websites to remember the choices made by that browser and to assist in preventing fraud and enhancing the security of eeZee PAY, eeZee PAY Websites and the TPH network. We may offer users of our eeZee PAY choices to opt-out of the collection and fingerprinting of browser data via our Cookie Consent Tool.

3.3.3 De-Identified Data About Your eeZee PAY Transaction

We, and our service providers, may automatically collect de-identified data about transactions you make using your eeZee PAY, whether an eeZee PAY or an eeZee PAY offered through a financial institution or other party.  The information collected includes the name of the merchant and the transaction data and time.  This information is used to enhance the security of eeZee PAY, eeZee PAY Websites and the TPH Network.

3.3.4 Third Party Analytics

We may use third-party web analytics services, such as those of Adobe Omniture. The analytics providers that administer these services use technologies such as cookies and web beacons to help us analyze how visitors use eeZee PAY and eeZee PAY Websites.  In eeZee PAY Mobile Application, you can turn off Adobe Omniture web analytics.

3.3.5 Tailored Advertising

We, and our service providers, may also collect information about your interactions with eeZee PAY and eeZee PAY Websites for use in providing you with content and advertising tailored to your individual interests. We may also use your personal data and other information obtained about you from companies that use or facilitate the use of other TPH products or services and from publicly available information systems to deliver advertising and offers that may be of interest to you. You may see certain ads on other websites because we (and our partners) use data collected via eeZee PAY and eeZee PAY Websites to customize advertisements to you on third-party websites. This collection and use allows us to target our messaging to users through demographic, interest-based and contextual means. In connection with providing you customized advertisements, third parties on our websites may track your online activities over time and across third-party websites by collecting information through automated means, including through the use of cookies, web server logs and web beacons. The information collected includes information about your visits to certain websites, the pages or advertisements you view and the actions you take on those websites. This data collection takes place on eeZee PAY Websites, on third-party websites and it may take place on eeZee PAY Mobile App. This process also helps us track the effectiveness of our marketing efforts.

3.3.6 Web Beacons and Email Tracking

When we send emails to people with an eeZee PAY account account, we may track behavior such as who opened the emails and who clicked the links. We do that to measure the performance of our emails and to improve our features. To do this, we include single pixel gifs, also called web beacons, in emails we send. Web beacons allow us to collect information about whether an email has been opened and the number of clicks inside that email. We use the data from those Web Beacons to create the reports about how our email campaign performed and what actions individuals took within the email (e.g. links clicked). If you do not wish for us to track emails we send you, some email services allow you to adjust your display to turn off HTML or disable download of images which should effectively disable our email tracking.

3.3.7 Customized Checkout

We may use information about your use of eeZee PAY, or which eeZee PAY account you use, in order to deliver you a customized merchant checkout experience.  After making an eeZee PAY transaction, we may drop a cookie on your device that will provide a customized eeZee PAY checkout button on merchant websites based on which eeZee PAY account you use, or, in some instances, which payment card you used for that transaction.  This will deliver a more seamless consumer eeZee PAY experience.  Merchants are not able to access this information.

4 How We Use the Personal Data We Collect

We may use the personal data we obtain about you to:

Create, manage and personalize your online account (including providing you with a transaction history), provide our products and services, and respond to your inquiries;

Route you to the appropriate eeZee PAY service based on whether you have an existing eeZee PAY relationship or an existing banking relationship with a participating issuer;

Validate your payment card information, authenticate your identity with your bank and tokenize your payment credentials to make your payments more secure;

Provide a customized checkout experience;

Create a view that shows you all of your eligible eeZee PAY accounts, including an eeZee PAY account (if you have one), and each account’s registered payment cards, when you click on the (Buy with eeZee PAY) button via a participating merchant’s mobile application;

Provide reporting back to the issuer of your enrolled payment cards and the merchants you transact with via eeZee PAY;

Anonymize personal information and prepare and furnish aggregated data reports showing anonymized information (including, but not limited to, the following: compilations, analyses, analytical and predictive models and rules, and other aggregated reports);

Perform data analyses (including anonymization of personal information) to determine, among other measurements, business performance, number of registrants, channels, transaction spend and site performance;

Provide, administer and communicate with you about products, services and promotions (including contests, sweepstakes, programs and other offers), including the display of customized content and advertising via eeZee PAY and elsewhere online;

Protect against and prevent fraud, unauthorized transactions, claims and other liabilities, enhance the security of eeZee PAY, eeZee PAY Websites, the TPH network and manage risk exposure and franchise quality;

Operate, audit, evaluate, monitor and improve our business and interactive assets (including by developing new products and services; managing our communications; determining the effectiveness of and optimizing our advertising; analyzing our products, services and websites; facilitating the functionality of our websites; and performing accounting, auditing, billing, reconciliation and collection activities);

Assist third parties in the provision of products or services that you request;

Enforce our eeZee PAY account Consumer Terms of Use;

As may be required by applicable laws and regulations or requested by any judicial process or governmental agency having or claiming jurisdiction over TPH or TPH’s affiliates;

Comply with industry standards and our policies

We also may use the information in other ways for which we provide specific notice at the time of collection.

5 Personal Data We Share

We do not sell or otherwise disclose personal data we collect about you, except as described in this Privacy Notice or otherwise disclosed to you at the time the data is collected.  In particular, your personal data may be shared:

Between TPH and our affiliates in order to provide eeZee PAY, eeZee PAY Websites and for the purposes described above.

With merchants and their service providers to perform and/or facilitate payment card transactions (including via Near Field Communication (NFC) and other contactless payment technology), to ensure the safety and security of those transactions (including card fraud detection and prevention), to resolve disputes, provide customer service, usage analysis and reporting and to provide eeZee PAY that you request.  Please note that merchants and their service providers may have their own privacy policies governing how they use and disclose personal data. We recommend that you review privacy policies of the companies you interact with to learn about their practices.

In addition, If you elect to connect your account to a merchant, we will provide personal data to that merchant in order to personalize your shopping experience and/or facilitate faster check-outs.  In such instances, merchants are not permitted to use your data for any other purpose.

With financial institutions and their service providers to perform and/or facilitate payment card transactions (including via Near Field Communication (NFC) and other contactless payment technology), to ensure the safety and security of those transactions (including card fraud detection and prevention), to authenticate and identity you and the payment cards you register with eeZee PAY account, to tokenize your payment credentials, to resolve disputes, provide customer service, to provide enrolment and usage analysis and reporting and to provide eeZee PAY that you request.   Please note that your financial institution(s) and their service provider(s) may make other uses of your information, which may include marketing to you based on your enrolment or use of their respective card in a wallet or wallet related transaction. Such third parties may have their own terms and privacy policies governing how they collect, use and disclose personal data. We encourage you to review such policies to ensure that you understand how these third parties use your information when you conduct certain activities with their card.

With our respective service providers who perform services on our behalf. We do not authorize these service providers to use or disclose the data except as necessary to perform certain services on our behalf or comply with legal requirements. We require these service providers by contract to appropriately safeguard the privacy and security of personal data they process on our behalf.

With third parties including identity verification services, service providers, government entities, utilities, public records, credit bureaus, telecomm providers, property files and watch lists. By signing up for an eeZee PAY, you acknowledge that we may disclose to, third parties, from time to time, your account information such as your name, address, phone number, email in connection with the processing of identity or account verification, fraud detection or as may otherwise be required by applicable law.

In the event TPH sells or transfers all or a portion of our respective business or assets. Should such a sale or transfer occur, we will inform you in due course about the identity of the new data controller, as well as of the details about how you may exercise your rights of access, correction and suppression after the sale or transfer has taken place, and we will use reasonable efforts to direct the transferee to use personal information you have provided to us in a manner that is consistent with this Privacy Policy.

If we are required to do so by law or legal process; to law enforcement authorities or other government officials; or when we believe disclosure is necessary or appropriate to prevent physical harm or financial loss, or in connection with an investigation of suspected or actual fraudulent or illegal activity.

6 Your rights and choices according to GDPR

You have rights to obtain details of the personal information that we hold about you, ask us to stop processing information and to have your personal information corrected or deleted. We offer you certain choices about what personal data we collect from you, how we use that information, and how we communicate with you.

Account Information and Email Marketing Preferences:  If you have an eeZee PAY account Account, you can access your account at any time by logging into your eeZee PAY mobile application. You can view or change your personal details and manage your marketing preferences here. You can at any time tell us not to send you marketing communications by e-mail by clicking on the unsubscribe link within the marketing e-mails you receive from us. We will apply your preferences going forward. In some circumstances, withdrawing your consent to our use or disclosure of your personal data will mean that you cannot take advantage of certain products or services.

Third Party Analytics:  As indicated above, we may use third-party web analytics services, such as those of Adobe Omniture, to analyze how you use eeZee PAY (if you have an eeZee PAY account), your usage of eeZee PAY Websites and other TPH websites.

Online Behavioral Advertising and Other Cookie Preferences:  We may offer users of eeZee PAY and visitors to eeZee PAY Websites choices to manage their cookie preferences through the Cookie Consent tool displayed in the bottom right corner of eeZee PAY websites or accessible via the AdChoices icon on eeZee PAY website.

Your right to access the information we hold about you:

You have the right to request access to and receive information about the personal data we maintain about you, update and correct inaccuracies in your personal data, to object to the processing of your personal data and have the information blocked or deleted, as appropriate. To update your preferences, ask us to remove your information from our mailing lists or submit an access request, please contact us as specified in the (How to Contact Us) section below. 7 How We Protect Personal Data

We maintain appropriate administrative, technical and physical safeguards to protect personal data against accidental or unlawful destruction, accidental loss, unauthorized alteration, unauthorized disclosure or access, misuse, and any other unlawful form of processing of the personal data in our possession.  The types of measures we take vary with the type of data, and how it is collected and stored.

When you provide personal data online, we use the industry standard for encryption on the Internet – Secure Socket Layer (SSL) technology – to help protect the data that you provide.  This Internet encryption standard scrambles data as it travels from your device to our server.  You will know that you are in a secure area of the Site when a lock icon appears on your screen that the (http) prefix of our URL address changes to (https. (The (s) represents (secure).  We also use digital certificates to ensure that you are connected to the authentic Site.

None of your payment card numbers or details are stored anywhere in our mobile application or transaction servers. Instead we use encrypted tokens, references to your card details, that only can be used by your account.

Our back-end systems and servers are hosted on Windows Azure by Microsoft and utilizes the latest’s security and internet safety features.

We will never ask you for your password in any unsolicited communication (including unsolicited correspondence, such as letters, phone calls or e-mail messages).  If you believe your user name and password have been compromised, please contact us by following the instructions provided in the section (How to Contact Us) below.

We also take measures to destroy or permanently de-identify personal data when there is no longer a business need to keep the information and in any case, for no longer than 13 months from the last time you have accessed your account.

8 Data Transfers

We may transfer personal information to countries other than the country in which the data was originally collected. These countries may not have the same data protection laws as the country in which you initially provided the information. When we transfer your personal information to other countries, we will protect that information as described in this Privacy Notice.

TPH is a global business. To offer our services, we may need to transfer your personal information among several countries, including the Europe, where we are headquartered. We comply with applicable legal requirements providing adequate safeguards for the transfer of personal information to countries outside of the European Economic Area or Switzerland and the USA.

9 Features and Links to Other Websites

On eeZee PAY Websites or via eeZee PAY, you may choose to use certain features for which we partner with other entities or click on links to other websites for your convenience and information.  These features, which may include social networking and geographic location tools, and other websites may operate independently from TPH.  They may have their own privacy notices or policies, which we strongly suggest you review.  To the extent any features or linked websites you visit are not owned or operated by TPH, we are not responsible for the sites’ content, any use of the sites, or the privacy practices of the sites.

10 Updates to Our Privacy Policy

This Privacy Policy may be updated periodically and without prior notice to you to reflect changes in our personal data practices.  We will post a prominent notice on our websites to notify you of any significant changes to our Privacy Policy and indicate at the top of the notice when it was most recently updated.  In addition, in the event of a material change to the Privacy Notice, you may be asked to reaccept the Privacy Notice when signing in to your account.
